We flatly reject the implementation of a state mandated ban on cruise vessels, identifying it as a manifestation of preventive law that violates the right to trade. However, we affirm the absolute right of private property owners to control access to their holdings. A pier or harbor is a material value, its owner possesses the exclusive right of disposal and may exclude any vessel for any reason, including the preservation of their property’s integrity.
The claim of fish depletion by the commercial fishing consortium is dismissed as a looter premise. In accordance with the Triple Mandate, the state does not recognize a mortgage on ownerless resources. Proved physical damage, such as erosion caused by excessive wakes, is a matter for the Law Courts to adjudicate as a specific initiation of force.
We do not provide a safety net for local aesthetics or industry survival. In this sanctuary, reality is the only arbiter of value.
